Costa Mesa band settles with CBS

In 1989, three men from the planet “Cynot3” started playing music in a Costa Mesa garage, calling themselves Supernova.

The band on Monday emerged victorious from its federal trademark dispute with Mark Burnett Productions and its CBS reality series “Rock Star: Supernova.”

The band settled with Burnett and will continue to perform and record as Supernova. The CBS band may use the name Rock Star Supernova. “Rock Star: Supernova” recently named Lukas Rossi of Ontario, Canada, as the singer, joining the rest of the band made of former Motley Crue drummer Tommy Lee, former Guns N’ Roses guitarist Gilby Clarke and former Metallica bassist Jason Newsted.

Jodey Lawrence, Art Mitchell and David Collins make up the local band, Supernova.

Additional terms of the settlement were not disclosed.

In June, the Costa Mesa band filed a federal trademark infringement lawsuit against CBS Broadcasting, Mark Burnett Productions and the members of the band. On Sept. 12, a federal judge in San Diego County issued a preliminary injunction against Mark Burnett Productions after John Mizhir, Supernova’s attorney, and the three members dropped the case against the others.
