Stock Sales by Lawyer for Hartcourt Probed

The Securities and Exchange Commission is seeking to enforce a subpoena against a Hartcourt Cos. lawyer over allegations that he sold stock last year after being told the SEC was investigating the Pasadena investment company.

The SEC on Tuesday asked a federal court in California to require lawyer John Furutani of Pasadena to turn over documents and submit to questioning about any stock sales from May 8, 2003, when he was told about the SEC’s plans to file a complaint against Hartcourt, to May 27, when the case was filed.

Furutani on Wednesday called the SEC’s subpoena “frivolous and harassing and unethical,” and said he didn’t comply with it because the requested documents were protected under attorney-client privilege.

Hartcourt’s shares, which trade over the counter, rose 1 cent to 53 cents on Wednesday.
