Callaway, Canadian Golf Group Settle Suit
Callaway Golf Co. said it has settled a lawsuit with the Royal Canadian Golf Assn. over its ERC II Driver.
In a joint statement, Callaway and the RCGA said they could do more to benefit the game of golf in Canada by settling any differences, dismissing the lawsuit and working more closely.
Each side will bear its own costs and attorneys fees in the lawsuit.
Callaway sued the association, the governing body of men’s amateur golf in Canada, last year in U.S. District Court in San Diego over the launch of a new driver that the association won’t allow at its events because it gives balls too much spring. Callaway claimed the RCGA unfairly and illegally interfered with the introduction of the ERC II forged titanium driver by ruling that it was nonconforming.
The U.S. Golf Assn. also found that the ERC II violated its standards, which resulted in a dramatic slowdown in sales of the driver, the Carlsbad-based company reported in June.
