SAN JUAN CAPISTRANO

The City Council on Tuesday voted 3 to 2 to deny former Councilman Jerry Harris’ request to have a 0.05-acre segment of a three-acre property rezoned to build a home at 27281 Viewpoint Circle.

Harris, who served on the council in 1992, wanted an exception to the General Plan to build a house in the Stonebridge area. The community is near the ridgeline east of Interstate 5.

Although Harris owns the land, a city open-space ordinance in the neighborhood prevents him from developing it.

Council members rejected the request on the basis that it would intrude into open space, conflict with the General Plan and be a precedent that could encourage future requests to develop open space.
