WEST HOLLYWOOD : Court Denies Gay Couple’s Marriage License Petition
A state appellate court has rejected a request by two gay men seeking a marriage license.
In a one-sentence ruling issued Monday, the 2nd District State Court of Appeal in Los Angeles denied a writ of mandate petition filed by a West Hollywood gay couple, Benjamin Cable and Marcial McCarthy. The pair had asked the court to order the Los Angeles county clerk’s office to issue them a marriage license after the clerk’s office refused to accept their license application in February.
“I am not surprised--disappointed, of course,” said Benjamin, who, like his partner, uses the last name of Cable-McCarthy. He said they plan to appeal the ruling to the state Supreme Court.
