FOUNTAIN VALLEY : Hearing Continued in Suit Over Drug Signs
A court hearing to determine whether a condominium owner can remove signs posted outside his home stating that it is a site of illegal drug sales was postponed Tuesday.
The hearing, scheduled in Orange County Superior Court, was continued until next Tuesday, City Attorney Alan R. Burns said.
Garrie Charles Culver, 46, who has not been arrested or charged with selling drugs, was ordered by the court in July to post the signs after the city filed a civil suit alleging that drugs were being sold at his condo.
At next week’s hearing, Culver plans to ask the court to lift the preliminary injunction issued in July. Burns said the city plans to pursue a permanent injunction that would order Culver to keep the signs posted.
Culver’s attorney, Emmett Raitt, said his client, who is blind and has lived at 11800 Tulip Court for 20 years, is entitled to a trial before being ordered to post such signs.
A trial date in the city’s suit is also expected to be set early next week.
