Suspect in Courthouse Slaying Released; Lack of Evidence Cited

A man arrested after last week’s courthouse killing was freed when prosecutors said there was not enough evidence to charge him with murder.

Lynn Waller, 30, was released Monday night from the West Valley Detention Center in Rancho Cucamonga, officials said.

Waller was booked for investigation of murder minutes after Thursday’s fatal shooting of Melvin Davis Robinson, 45, of San Bernardino. Witnesses told police that Waller was the gunman.

“At this point, there simply was not sufficient evidence to charge Mr. Waller,†said Deputy Dist. Atty. Brian Saunders.

Police detectives were still investigating the case. Investigators said Robinson intervened in an argument between his 25-year-old daughter, Kimberly, and Waller. The couple were awaiting a court hearing to decide custody of their two children.

In a jail interview last week, Waller denied shooting Robinson. He said it was Robinson who pulled a gun on another man. Waller said he did not see who shot Robinson.
