South El Monte : Noise Restrictions OKd
The City Council, responding to citizen complaints, last week imposed new restrictions on loud music and other noise.
The council voted 4 to 1 to pass an urgency ordinance that will allow sheriff’s deputies and city code enforcement officers to enforce noise laws based on how far sound carries, not on decibel levels.
Previously, the code was enforceable only when noise exceeded certain decibel levels: a maximum of 45 decibels allowed from 10 p.m to 7 a.m., and 55 decibels allowed from 7 a.m. to 10 p.m.
Now, if noise can be heard at a distance of 50 feet from its source or, in the case of a party, 50 feet beyond the property line of the dwelling, those responsible will be warned. If there is a second violation, offenders can be charged with a misdemeanor.
Raul Pardo, the only council member to vote against the move, said he is concerned because the ordinance does not distinguish between wild, late-night parties and Sunday afternoon gatherings.
Council members said they plan to consider further changes in the city’s noise enforcement policy within 30 days.
