The Nuclear Regulatory Commission was ordered by the U.S. 9th Circuit Court of Appeals to hold a new hearing on fire safety and potential radiation release at the Diablo Canyon nuclear plant. The appeals court ruled for the second time that the NRC had approved expanded nuclear waste storage at the San Luis Obispo plant without proper consideration of possible safety problems. The three-judge panel, however, denied a request by plant opponents that they forbid use of the new waste storage facilities.
