Delaware Chancery Court Judge William Allen has ruled that since the wife of Ivan F. Boesky and investment bank Drexel Burnham Lambert Inc. have not been found guilty of any wrongdoing, they must be included in any distribution of proceeds from liquidation of a Boesky partnership. In an April 28 ruling that was clarified last week, the court denied a request that Drexel and Boesky’s wife, Seema, be excluded from the payments. The request was made by David Herwitz, the trustee overseeing the liquidation of the trading firm Ivan F. Boesky & Co. Herwitz asked that Seema Boesky and Drexel be excluded to protect innocent partners in the Boesky venture.
