The legal dispute pitting Ernest and Julio Gallo against their younger brother, Joseph, over his right to use “Joseph Gallo” on the label of cheese he produces in Livingston will move into federal court in Fresno June 6 as each side seeks to dismiss the other’s lawsuit. The elder brothers, owners of E & J Gallo Winery in Modesto, the world’s largest, sued Joseph two years ago in an effort to force him to stop using his name on cheese “Joseph Gallo,” arguing that he was infringing on a name the winery’s efforts had made famous. Joseph Gallo later filed a countersuit charging that his brothers had cut him out of a one-third interest in the family’s winery at the time of their parents’ death in 1932 when Joseph was still a minor. The case is scheduled to go to trial Nov. 15.
