The U.S. Court of Military Appeals, the nation’s highest military court, reversed the rape-attempted murder conviction of a U.S. Marine because his civilian lawyer fell “far short of reasonable competence” in not investigating the man’s alibi. The decision also set aside the 30-year prison sentence and $18,000 pay forfeiture imposed on Cpl. Lindsey Scott, who is serving the sentence at the military prison in Ft. Leavenworth, Kan. Scott, then 25, was convicted in the 1983 attack on the wife of a fellow Marine at the Quantico, Va., Marine Base. The case was sent back to the Navy for a possible rehearing.
