Wife Loses Benefits for Officer She Killed

ALBANY, N.Y. — A woman who accidentally shot and killed her policeman husband cannot continue collecting workers’ compensation benefits for his death because he did not die on duty, the state’s top court ruled Thursday.
The ruling by the state Court of Appeals overturned a lower court decision that allowed Diane Koerner and her two children to collect $180 a week for the death of her husband, Sanford Koerner Jr.
Diane Koerner accidentally shot her sleeping husband in December, 1978, when she tripped in the dark while carrying his police service revolver from another room into the couple’s bedroom, an assistant state attorney general said.
