After David Todd Brown was sentenced to two years in prison for burglary and violation of probation, he politely asked San Jose Superior Court Judge Joseph F. Biafore if he could say one thing. When the judge agreed, Brown turned around, pulled down his orange jail-issued trousers and bent over--exposing his buttocks to Biafore. A bailiff said Brown then told the judge, “See you in hell,’ as he pulled his pants back up. The other inmates “just sort of giggled,” the bailiff said. “They didn’t want to say anything since most of them were waiting for their turn to be sentenced by the judge.” Brown’s conduct resulted in his being charged with contempt of court and indecent exposure. Brown later pleaded guilty to the contempt and exposure charges in Municipal Court and was sentenced to six months in County Jail to be served when he returns from state prison.
