Attorneys for the state of Georgia have asked a federal judge to order a new trial on Jan Kemp’s lawsuit against two University of Georgia administrators--or at least to cut her $2.57-million damage award.
A U.S. District Court jury handed down the award for Kemp Feb. 12. She had sued Virginia Trotter, vice president for academic affairs, and Leroy Ervin, developmental studies director, claiming that she was fired as English coordinator in the remedial Developmental Studies Program in retaliation for her protests over preferential classroom treatment for athletes and other influential students.
Asst. Atty. Gen. Pat McKee told U.S. District Judge Horace Ward that, if the verdict stands, the state will not oppose Kemp’s request for reinstatement at Georgia.
