Pair Denied Retrial in Faith-Healing Death of Daughter
INDIANAPOLIS — A Faith Assembly couple whose baby died of untreated bacterial meningitis lost their plea Thursday for a new trial on child neglect and reckless homicide charges.
The Indiana Court of Appeals upheld the convictions of David B. and Kathleen C. Bergmann of Ligonier in the June 7, 1984, death of their 9-month-old daughter, Allyson. Noble Superior Court Judge Roger B. Cosbey had sentenced them to 10 years in prison.
The parents had tried to treat the baby with prayers, fasting and invocations of Scripture, according to the tenets of their church.
